Fight over legislative, state powers headed to Indiana High Court

INDIANAPOLIS (WPTA) - The Indiana Supreme Court will rule on a case that will determine where certain powers in State government lie -- with the governor or with lawmakers.

The High Court on Wednesday took over a lawsuit filed by Gov. Eric Holcomb in an effort to overturn a law -- passed despite his veto -- that designates some authorities asserted by Holcomb during the COVID-19 public health emergency to the Indiana House and Senate. The Supreme Court will hear the appeal, which follows a ruling from a Marion County judge in October, favoring the legislature.

Chief Justice Loretta Rush issued the order moving the case to the Supreme Court. The matter is scheduled for arguments on April 7. Private attorneys are representing the governor, with Attorney General Todd Rokita representing the lawmakers.
